Robert and Leslie Chambers are the parents of Ferren Chambers. Ferren suffers from cognitive and developmental disorders and, although now in her twenties, functions on the level of a young child. In 2005, the Chambers sued the School District of Philadelphia Board of Education (the "School District"). Alleging that the School Districts failure to provide Ferren with an appropriate education obstructed her intellectual growth, the Chambers asserted various statutory and constitutional violations, both in their own right and on Ferrens behalf. The District Court granted summary judgment for the School District on all of the Chambers claims. The Chambers now challenge that ruling in most, but not all, respects. Because we conclude that the District Court erroneously found that the Chambers waived two of the statutory claims asserted on Ferrens behalf, we will vacate that portion of its ruling and remand for further proceedings consistent with this opinion. We will affirm the balance of the District Courts ruling.
